Terms of Service

These Terms of Service set out the rules for using the Arietta Cars website available at www.ariettacars.com, which is an electronic intermediary platform connecting customers seeking premium car rentals with operators providing such services.
§1 General provisions and definitions
These Terms set out the rules for using the Arietta Cars website (the „Service”) and the rights and obligations of its users. The Service is operated in Polish, and the governing law is Polish law.
Terms used: (a) Service Provider — the entity specified in §2; (b) Service — the electronic intermediary platform available at ariettacars.com; (c) Customer — a natural person, including a consumer within the meaning of Article 22¹ of the Polish Civil Code, using the Service to browse offers or submit an Inquiry; (d) Operator — a business providing car rental services with an active account in the Service; (e) Inquiry — the electronic contact form submitted by the Customer to the chosen Operator; (f) Rental Agreement — the agreement concluded directly between the Customer and the Operator, to which the Service Provider is not a party.
Using the Service constitutes acceptance of these Terms.
§2 Service Provider details

The above details satisfy the requirements of Article 5 of the Polish Act on Providing Services by Electronic Means of 18 July 2002.
§3 Nature and scope of services
The Service is an electronic intermediary platform. The Service Provider presents offers from Operators and provides a vehicle search and communication tools (the Inquiry form).
The Service Provider does not provide car rental services. The Service Provider is not a party to the Rental Agreement concluded between the Customer and the Operator and does not become one at any point.
The scope of services provided by the Service Provider electronically includes: (a) presentation of Operator offers including descriptions and photos; (b) vehicle search and filtering; (c) forwarding Customer Inquiries to designated Operators; (d) Operator account management including an offer management dashboard; (e) email notifications related to the above functions.
Use of the Service by Customers is free of charge. Financial terms for Operators are defined by a separate agreement.
The Service is currently in a pre-launch phase. The listings displayed are for demonstration purposes, and the vehicle images used are visualizations generated using artificial intelligence (AI) technology and do not represent specific vehicles available for rental or actual fleet vehicles operated by Operators. Inquiry submission and related Operator communication functions are not active during this phase. The end of the pre-launch phase and activation of full functionality will be announced via the Service.
§4 Technical requirements
Proper use of the Service requires: an Internet-connected device, a web browser supporting HTML5, CSS3, JavaScript and cookies, and an active email account (for registration and notifications).
Recommended browsers: Google Chrome, Mozilla Firefox, Safari, Microsoft Edge in their current versions.
The Service Provider is not liable for damages arising from failure to meet the above technical requirements.
§5 Operator registration and account
Accounts in the Service are available only to Operators by invitation (invite-only model). Customers use the Service without registration.
Operator registration requires: a valid invitation token, an email address, a password of at least 8 characters, and a company name.
The Operator represents that: (a) it is a business within the meaning of Polish law; (b) it holds all required permits, licenses and insurance necessary to conduct car rental activities; (c) the data provided at registration is true and current.
The Service Provider reserves the right to approve, reject, suspend or remove Operator accounts in case of breach of these Terms or applicable law.
§6 Submitting Inquiries
Submitting an Inquiry does not require registration. The form requires: name, email address, planned rental dates. Phone number and message are optional.
The Inquiry is forwarded directly to the Operator selected by the Customer. The Service Provider does not interfere with the content of the Inquiry or subsequent negotiations between the Customer and the Operator.
The Customer represents that data provided in the form is true, current and relates to the Customer (or a person the Customer is authorised to represent).
It is prohibited to use the Service to: send spam, false or non-genuine Inquiries; impersonate others; engage in unlawful or unethical activity; attempt to circumvent Service security. This prohibition stems from Article 8(3)(2)(b) of the Polish Act on Providing Services by Electronic Means.
§7 Operator obligations and liability
The Operator bears full and sole responsibility for: (a) the content of published offers, including truthfulness of descriptions, photos and prices; (b) holding all required permits and licenses (including transport licenses where applicable); (c) vehicle insurance (liability, comprehensive, assistance); (d) technical condition, safety and cleanliness of vehicles; (e) performance of the Rental Agreement, including vehicle handover and return, protocols, deposits and settlements; (f) handling complaints, damages and claims raised by the Customer in connection with the Rental Agreement.
The Operator undertakes to respond to Inquiries within a reasonable time (market standard: 24 hours). Failure to meet this standard does not constitute a breach of these Terms.
The Operator may not use personal data of Customers obtained through the Service for purposes other than handling the specific Inquiry and any resulting Rental Agreement. The Operator becomes a separate data controller within the meaning of the GDPR and bears independent responsibility for such processing.
§8 Limitation of Service Provider liability
The Service Provider provides solely an electronic service consisting in operating an intermediary platform. Accordingly, the Service Provider is not liable for:
(a) technical condition, safety, cleanliness or other properties of vehicles offered by Operators; (b) Operators holding required insurance, permits and licenses; (c) financial terms of the Rental Agreement, including deposits, additional fees, cancellation policies; (d) property, personal or non-material damage caused by the Operator or Customer in connection with the Rental Agreement; (e) fines, administrative penalties, toll fees, parking fees and other costs arising from vehicle use; (f) the currency and truthfulness of information published by Operators, including prices, vehicle availability and technical specifications; (g) verification of Customer identity, driving licence or financial standing; (h) non-performance or improper performance of the Rental Agreement by either party.
The Service Provider's liability is limited to ensuring the proper operation of the electronic platform within the scope defined in §3.
The Service Provider does not guarantee uninterrupted or error-free availability of the Service. Planned technical breaks will be communicated in advance where possible.
§9 Complaints regarding the Service
Complaints regarding Service functioning (technical errors, downtime, malfunction) should be sent to: [EMAIL_KONTAKTOWY].
A complaint should include: name or company name, contact email address, a detailed description of the issue and — if possible — the date and time when the problem occurred.
The Service Provider will consider the complaint within 14 calendar days of receipt and respond to the email address provided.
Complaints concerning the Rental Agreement (vehicle condition, service quality, settlements, damages) should be directed to the Operator — the Service Provider has no authority to resolve them.
§10 Right of withdrawal (consumers)
A Customer who is a consumer has the right to withdraw from the contract for electronic services (use of the Service) concluded with the Service Provider within 14 days without stating a reason, in accordance with Article 27 of the Polish Consumer Rights Act.
Services provided by the Service Provider to the Customer are free of charge, so the right of withdrawal is informational in nature.
Withdrawal from the Rental Agreement concluded with the Operator is governed by the law applicable to that agreement (in particular provisions of the Polish Civil Code on lease agreements) and the Operator's terms.
§11 Out-of-court dispute resolution
A Customer who is a consumer has the right to use out-of-court methods of complaint handling and claim enforcement, in particular:
(a) the European Commission's ODR platform available at: https://ec.europa.eu/consumers/odr;
(b) mediation conducted by the competent regional inspector of the Trade Inspection (Inspekcja Handlowa);
(c) assistance from a municipal or county consumer ombudsman (list available at www.uokik.gov.pl);
(d) the standing amicable consumer court at the regional inspector of the Trade Inspection.
Use of the above procedures is voluntary.
§12 Personal data protection
The rules of personal data processing by the Service Provider are set out in the Privacy Policy available at: /privacy
The Privacy Policy fulfils the information obligations arising from Article 13 of the GDPR.
§13 Final provisions
Matters not regulated by these Terms are governed by Polish law, in particular: the Civil Code, the Act of 18 July 2002 on Providing Services by Electronic Means, the Act of 30 May 2014 on Consumer Rights, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
The court competent to resolve disputes related to the use of the Service is the court competent for the seat of the Service Provider, subject to mandatory provisions on exclusive jurisdiction and provisions protecting consumers (Article 31 of the Polish Code of Civil Procedure).
The Service Provider reserves the right to amend these Terms. Amendments take effect 14 days after publication of the amended version in the Service. Continued use of the Service after this period constitutes acceptance of the changes.
