Rental Company Terms
Effective date: 22.10.2026
These Terms set out how rental companies use the Arietta Cars service (ariettacars.com, the „Service”). Customers are bound by the Terms of Service.
§1 Service Provider and definitions
The Service Provider is Miland s.c., registered at ul. Grzybowska 30/205, 00-863 Warszawa, NIP: 5273236856, REGON: 545490350.
A Rental Company is a business providing vehicle rental that has an account in the Service. A Customer is a consumer or a business using the Service. A Booking is a Customer's request for a vehicle rental sent through the Service to a Rental Company (called an Inquiry in the Terms for customers). The Rental Agreement is concluded directly between the Customer and the Rental Company; the Service Provider is not a party to it.
The Commercial Terms are the individual arrangements between the Service Provider and the Rental Company: the commission rate, the payment term and the first month covered by a statement. In case of conflict with these Terms, the Commercial Terms prevail.
§2 Conclusion of the agreement and account
The agreement between the Service Provider and the Rental Company consists of these Terms and the Commercial Terms. The Rental Company concludes it by accepting the Commercial Terms by signature or by email. It receives these Terms as a PDF together with the Commercial Terms, before accepting them.
An account is created from an invitation by the Service Provider or set up by the Service Provider. By creating an account from an invitation, the Rental Company accepts these Terms. The profile and offers are published after the Commercial Terms are accepted and the account is approved.
The Rental Company represents that it is a business, holds the permits and insurance required for vehicle rental, and that its account data is true and current. It is responsible for the people it gives access to the account. It uses the brand under which it operates in the Service with the consent of the brand's owner.
The Rental Company must provide the Service Provider with the data required for the DAC7 report to the Head of the National Revenue Administration, and a natural person running the Rental Company also with their date of birth. The Rental Company receives a copy of the submitted report by 31 January.
Article 66¹ § 1–3 of the Polish Civil Code does not apply to the agreement.
§3 Scope of the Service
The Service is for vehicle rental, including with crew from the Rental Company, e.g. for a film set, photo shoot, exhibition or event. The Service is not for booking passenger transport, e.g. driving a bridal couple to their wedding. The Rental Company may not confirm in the Service a Booking that includes passenger transport.
The Rental Company is responsible for the content of its offers (descriptions, photos, prices), the technical condition and insurance of vehicles, the deposit, performance of the Rental Agreement, and related complaints and damage.
The Rental Company must respond to Bookings within a reasonable time and fulfil the Bookings it has confirmed.
Files and content sent in conversations must be lawful, and the Rental Company must have the right to share them, including any personal data they contain.
§4 Offers, moderation and ranking
Offers are added by the Rental Company in its panel or by the Service Provider at its request, from content provided by the Rental Company.
The Service Provider may decline to publish or hide an offer that is unlawful or breaches these Terms, is misleading (photos, price, availability) or infringes third-party rights.
Unlawful content can be reported to kontakt@ariettacars.com, stating the offer or message, the reason, and your name and email.
The order of offers depends on the search criteria and sorting chosen by the Customer; by default, more recently added offers rank higher. Offers that, according to the Service's data, do not meet the criteria, including offers unavailable on the chosen dates, may be omitted or shown separately. Similar offers are ordered by how closely they match the search, then by newest. The rules are the same for all Rental Companies.
§5 Commission and settlements
Commission is due on a rental concluded as a result of a Booking made in the Service, including when the details (price, dates, pickup) were agreed later outside the Service, e.g. by phone. The Rental Company must confirm such a rental in the Service.
When confirming a rental, the Rental Company must enter the full amount agreed with the Customer, including vehicle delivery. The commission base excludes the deposit and charges made after the vehicle is returned (damage, fuel, penalties). Commission is calculated on this amount net of VAT at the rate in the Commercial Terms, plus VAT where due.
After the end of each month, the Rental Company receives in its panel and by email a statement of confirmed, unsettled rentals that started by the end of that month.
Within 72 hours of issue, the Rental Company must accept the statement or raise an objection to it in the Service; after that the statement is accepted automatically. If no agreement is reached within 14 days of the objection, the Service Provider invoices the undisputed rentals.
The Rental Company must withdraw a cancelled rental in its panel before accepting the statement. If a rental on an accepted statement did not take place or its price changed, the Rental Company must report it by email within 30 days of the planned end of the rental, and the Service Provider issues a correction.
After the statement is accepted, the Service Provider issues an invoice and makes it available by email or in KSeF. The payment term is set in the Commercial Terms.
§6 Content and licence
The Rental Company retains the rights to the photos, descriptions, name and logo provided to the Service or taken with its consent from its website (the „Content”). It grants the Service Provider a free, non-exclusive licence to the Content, without territorial limits, in the following fields: (a) publication in the Service and on the internet; (b) reproduction, cropping, compression and thumbnails, and use of the Content so modified; (c) promotion of offers and the Service, including on social media and in advertising. The Service Provider may grant sublicences to the extent needed for publication on those platforms.
The licence also covers use of the Content before the agreement was concluded and lasts for the term of the agreement. Promotional materials published during that time may remain published for 5 years after the agreement ends.
The Rental Company warrants that it holds the rights to the Content and the brand, including from photographers, and the consent of people shown in the photos. The Rental Company is liable for third-party claims on these grounds.
§7 Data
For Customer data from Bookings, documents and conversations in the panel, the Service Provider and the Rental Company are separate controllers under the GDPR. The Rental Company may not use this data for any purpose other than handling the Booking and the Rental Agreement. The Service Provider does not share the Rental Company's Customer data, conversations or agreed prices with other rental companies.
The Rental Company has its offers, Bookings, conversations and statements in its panel. The Service Provider uses Service data to run the Service, for settlements and for aggregate statistics.
Service data is stored in AWS in Frankfurt. Other providers through which data passes are listed in the Privacy Policy. Bookings with conversations are deleted after 3 years, but not before the rental ends.
§8 Changes to these Terms and the rate
The Service Provider announces changes to these Terms or to the commission rate at least 15 days in advance, by email to the Rental Company's address given in the Commercial Terms. During that time the Rental Company may terminate the agreement with immediate effect.
A new rate applies from the statement for the first full month after it takes effect.
§9 Suspension and termination
The Service Provider may suspend an account or offer for breach of these Terms or the law, or if the Rental Company has not provided the data required for the DAC7 report. The Service Provider gives the reason for suspension by email, and the Rental Company may reply with an explanation.
The Rental Company may terminate the agreement by email at any time, with immediate effect. The Service Provider may terminate it by email with 30 days' notice, giving the reason.
The Service Provider may terminate the agreement with immediate effect, giving the reason by email, if the Rental Company repeatedly breaches these Terms, in particular by providing false information, failing to confirm rentals from Bookings in the Service or failing to pay invoices despite a reminder, and where required by law.
Rentals confirmed before the agreement ends are settled under §5, even if they start later; the Rental Company keeps access to the panel until the last statement is accepted. The profile and offers are removed on the day the agreement ends, and photos and logos are deleted from the Service after 30 days. Offer descriptions remain with Bookings until they are deleted under §7. On request made during that time, the Rental Company receives an export of its offers, Bookings and statements.
§10 Final provisions
Each party's liability to the other is limited to the total commission paid in the last 12 months, except for intentional damage and third-party claims under §6.
Point of contact for Rental Companies, Customers and authorities: kontakt@ariettacars.com, in Polish. The Service Provider handles complaints within 14 days.
Polish law applies. The current version of these Terms takes effect on 22.10.2026.
